A guide to finances during divorce has been published by the Ministry of Justice.
Entitled Sorting out your finances when you get divorced, it is aimed both at couples splitting up and their friends and family. It is designed to help them resolve their financial issues, better understand the approach taken by family court judges, and reach agreement as quickly as possible.
The Ministry hopes the guide, written in plain English, will be useful to unrepresented litigants in person trying to navigate the divorce process without the help of a family solicitor. It offers accessible guides to family law as well in-depth information on such key family issues as maintenance and housing. Information on the dissolution of civil partnerships is also featured.
Publication of the new guidance was welcomed by Sir James Munby, President of the Family Division. He declared:
“I am delighted to recommend the latest in a series of guides designed to help Litigants in Person who may be confronting the seemingly daunting prospect of negotiating their own agreements in the context of divorce and family breakdown. It provides a succinct summary of the law for those who cannot afford legal advice to reach financial agreements without the need for protracted court proceedings.”
