The case centred on financial remedy proceedings that included two properties, one of which was located overseas, and over £1 million in pension assets.
The case was complex for several reasons: our client’s spouse made claims that he was unable to work as he was a carer for our client’s aunt and due to mental health issues. Unfortunately, we also became aware that he had rented out the international property, which meant that there was a significant decrease in its value.
Working to protect our client’s financial interests in this high-net-worth divorce, Alexandra Tomley, an Associate in Stowe’s team of Liverpool divorce lawyers, built a detailed case.
Tax specialists were consulted about any international tax liabilities; pension actuaries valued the pension assets; and detailed valuation reports were produced, including for the overseas property.
This detailed work resulted in Stowe successfully proving the case. The higher valuation of the international property was accepted, as was an accurate value of the pension assets. At the final hearing, the judge ruled in our client’s favour, securing a fair financial settlement. Our client was also awarded a £20,000 costs order against his husband due to the husband’s failure to comply with court directions, which led to delays.
Although the process took some time and was longer than hoped, our client was ultimately very pleased with the outcome, which resulted in a fair financial settlement and additional costs awarded:
