No. You’re not legally required to use a solicitor to divorce in the UK, and many people complete the online application themselves. The divorce itself is largely administrative.
Where people often come unstuck is with finances or children, because those issues sit outside the divorce and aren’t automatically addressed. This is particularly common for couples who are separated but not divorced, where financial claims can remain open even after living apart for some time.
We regularly support people in Bracknell who assumed the divorce brought everything to an end. Then, discover later that certain matters were still legally outstanding. A divorce solicitor can clarify what the divorce actually settles, and what needs separate attention.
At its simplest, a family law solicitor helps you understand your legal position and what usually needs to be dealt with. That often includes managing communication, helping work through financial discussions, and supporting arrangements for children within the legal framework.
When advising clients in Bracknell, our family law solicitors often focus on resolving matters calmly and proportionately. They also make sure any agreement reached properly protects your position.
The divorce process follows a set legal structure. One or both spouses apply, there is a built-in waiting period, and the court then makes a conditional order.
After a further stage, a final order is granted, which legally ends the marriage. What often causes confusion is that this process only ends the marriage itself.
It does not deal with finances or arrangements for children. These are handled separately under the divorce process in England and Wales.
No. There is no automatic rule that assets are divided equally. The law looks at what is fair, within clear limits. Housing and income needs are addressed first, particularly where children are involved.
Only once those needs are met does the court consider how remaining assets should be shared. This is why outcomes don’t always look equal, even though the legal starting point is fairness.
Parents with parental responsibility are treated equally by the law. However, child arrangements are not decided on the basis of parental rights. The focus is on what best supports the child’s welfare, including their routine, relationships, and stability.
There is no automatic assumption of equal time. From our experience in Bracknell, arrangements that reflect how a child actually lives are often more workable.
Emma joined us in September 2017 and is the Managing Partner of our Esher, Guildford & Brighton offices. She advises on all aspects of family law and assists clients going through a separation whether they are married, in a civil partnership or unmarried.
