You can apply for a divorce yourself. There is no legal requirement to use a solicitor in England and Wales. Many people complete the application online without help.
What often matters more is what sits alongside the divorce. Decisions about money, property or children can have long-term effects if they are made informally or without advice. We regularly speak to people based in Esher who are comfortable handling the paperwork, but want clarity on the wider impact before moving forward.
It depends on the situation. Some divorces are straightforward and involve little disagreement. Others include finances, children or ongoing conflict where legal guidance can make a real difference.
Using a divorce solicitor is less about making things adversarial and more about understanding risk. Court cases and negotiations can affect housing, income and time with children. Knowing how the process works helps people avoid mistakes that can be difficult to correct (and pay for) later.
There is no fixed entitlement for either a wife or a husband. Divorce law in England and Wales is gender neutral. Outcomes depend on individual circumstances rather than status.
This matters because many people start with assumptions about what they should receive. In practice, the court looks at needs, contributions during the marriage and future financial security during divorce. Understanding this early often helps people focus on reaching a workable settlement rather than arguing over expectations.
For most people, the first step is actually not starting the divorce but understanding their position for leaving their partner. That usually means looking at finances, housing and how day-to-day life would work during separation.
Early decisions can shape how your divorce goes. Moving out or agreeing on arrangements informally may feel practical at the time, but could potentially limit your options later down the line. We recommend speaking to a family law solicitor early is often the best solution, rather than taking immediate action.
The law does not favour mothers or fathers above each other. Decisions about child arrangements are based on what is best for the child.
This is important because many fathers worry they will be at a disadvantage from the start. In reality, the focus is on the child’s welfare and maintaining relationships where it is safe and appropriate. Most difficulties arise from conflict rather than the law itself, and many arrangements are agreed without needing court involvement.
Divorce costs differ from case to case, particularly where there are financial issues or child arrangements to resolve. Once we know your specific circumstances, our team can offer an initial cost estimate. For more detailed guidance on costs in complex matters, read our “how much does divorce cost?” guide and our divorce costs information. We can also provide a fixed-fee divorce option if your case is amicable and straightforward.
