Rebecca Finnigan, a Partner in Stowe’s team of Liverpool family law solicitors, was instructed by a wife in a divorce and financial remedy case involving a very high-earning husband. The husband’s income was higher than the threshold assessable in the usual way by the Child Maintenance Service (CMS). This meant that making a standard child maintenance calculation was not available, and a bespoke financial arrangement would have to be negotiated.

With our guidance and support, our client attempted to resolve matters amicably through mediation. However, despite best efforts, discussions broke down, and court proceedings then became necessary. The case involved a number of complex financial issues, including child maintenance, as well as ensuring that our client would have appropriate access to funding for her legal representation.

Complex Divorce and Financial Settlement Case

Rebecca Finnigan and our dedicated team of Liverpool solicitors provided clear, strategic advice from the outset. When court delays resulted in an unacceptable waiting time, Rebecca advised her client to move forward via a private Financial Dispute Resolution (FDR) hearing. This option has become an increasingly popular method to resolve high-conflict or high-net-worth divorce cases.

Due to the husband’s refusal to use matrimonial funds to cover the wife’s legal costs, Stowe also worked with our client to help secure a litigation loan. This ensured she had the resources needed to continue with her case on an equal footing.

To help provide additional emotional support and clarity throughout the process, the team at Stowe took a holistic approach that meant our client had the opportunity to work closely with a divorce coach. Our client’s independent financial advisor was also invited to attend the private FDR to support negotiations with a focus on long-term financial security.

Child Maintenance and Financial Security Secured

Stowe Family Law used the private FDR to achieve a successful divorce settlement, ensuring the client received a fair level of child maintenance that reflected the husband’s high income. Rebecca also ensured that the settlement included the repayment of the litigation loan from matrimonial assets. This was a highly successful result, giving our client peace of mind and financial stability.

“Over the past two years, Rebecca Finnigan has been an invaluable resource during my complex divorce proceedings. Her expertise in family law, combined with her genuine understanding of my situation, made a significant difference in navigating this challenging process. Rebecca took the time to gather a skilled and dedicated team, ensuring that I received comprehensive support every step of the way. Their professionalism and commitment to achieving the best possible outcome for my case were evident throughout. I am incredibly grateful for the guidance I received, and I wholeheartedly recommend Rebecca and her team at Stowe Family Law in Liverpool to anyone in need of trusted legal assistance.”
