    A financial settlement in divorce is an agreement that fairly divides your assets and financial responsibilities once the marriage ends.

    This can include:

    • Personal Items valued over £500 must be disclosed
    • Debts, loans, and credit cards

The importance of finalising financial settlements

While it is possible to finalise your divorce without sorting out the financial arrangements, it is not usually recommended. Ending a marriage does not prevent either party from claiming financial provision later on. To ensure that neither party can make any further claim against the other in life or on death, you need to enter a clean break consent order.

Not settling financial matters before finalising your divorce can lead to several issues:

  • Remarriage trap: If you remarry, you could lose some or all rights to claim from your former spouse. Finalising a financial settlement first avoids this risk.
  • Unexpected death: If one party dies during financial negotiations, the surviving spouse might lose out on benefits. Finalising the financial settlement first can protect these benefits.
  • Tax implications: Transferring assets between spouses can benefit from tax exemptions. Sorting out finances before the final divorce order can help avoid tax charges.
  • Changing circumstances: Delaying financial settlements can lead to unfavourable outcomes if circumstances change significantly.

Offer applies to the Stowe Family Law no-fault divorce fixed fee package only, which is charged at £750+VAT. It cannot be used by clients who do not qualify for the fixed-fee package, who fall outside the fixed-fee package part way through their divorce or instruct us to deal with their divorce on an hourly rate. The offer does not include court fees – currently £612 and this must be paid by the applicant in the divorce. If the client is the respondent in the divorce, the offer is worth £385+VAT. Only available for clients who also instruct Stowe Family Law for their financial settlement and spend over £1,000 in the first 4 months of the case file being opened. If there is no spend of £1,000 with 4 months, the client will be responsible and charged for the cost of the fixed-fee divorce. Offer is subject to availability and can be withdrawn or changed at any time. Stowe Family Law reserves the right to exclude any person from participating in the offer on reasonable grounds, for example a conflict issue. There is no cash alternative.
