A few case studies where we have represented overseas clients
We were instructed by a solicitor in Australia seeking advice for their client , a British national, who was going through a divorce in Australia. There were English pensions involved and we were able to obtain pension sharing orders for the client by making an application for financial relief following an overseas divorce (a Part III application).
- UK based property
We were instructed by a client where he and his former wife were residing in the US however they were both British nationals and there was a property still in England. There was a concern that his wife was delaying a sale of the property and we were able to advise on options available to secure a sale of the property.
- Maintenance orders
We were instructed by a client living in the Far East who had been served with an order to enforce a maintenance order that he was obliged to pay. His financial circumstances had changed and he could no longer afford to make the payments. We were able to successfully advise on the different routes of enforcement including the Reciprocal Enforcement of Maintenance Orders legislation (REMO) and also how the maintenance order could be varied.
- Financial settlements for clients overseas
We represented a client in Thailand whose former wife still residing in England filed an application with the court for a financial settlement. Through video conferencing we were able to take instructions from the client and negotiate a financial settlement. We regularly represent clients all over the world and in the last twelve months for example have represented clients in the US and Canada, Dubai and Qatar, Australia, New Zealand, Hong Kong, Singapore, Japan, the Caribbean and across Europe.
- International Children matters
We advised in a case involving non-British parents to children living in England prior to their marriage breaking down. Following the divorce, the parents sought the English court’s assistance about the general arrangements for the children. We successfully advised our client about and obtained the court’s permission for the mother to permanently relocate with the children outside of the country. We also advised about, and obtained, the necessary European certificates which assist with enforcement.
International Divorce Lawyers
Early advice is essential to ensure that the most suitable jurisdiction is secured for a client, particularly in European cases, where parties can “race” to issue proceedings in different countries.
In cases where we are unable to help you we will be able to put you in contact with a lawyer overseas. Sometimes it is important to compare the different jurisdictions and the different possible outcomes for you. In those circumstances we often take part in three way conference calls to help you decide which is the best country for you.
In such cases, assuming that the grounds to proceed exist in both countries, the case will be heard in the first court in which proceedings are issued. This can have a dramatic impact upon the eventual financial settlement so timing is of the utmost importance.

Finances & Asset Protection

For clients who are resident overseas, our International Family Law Department can make applications for interim maintenance, if bank funding for legal fees is not possible.
