Stowe Family Law lawyers in Birmingham assist clients on complex family law matters
The Stowe team in Birmingham is a renowned group of solicitors, headed up by Managing Partner Rebecca Calden-Storr. Partners Claire Cleary and Sara Morton serve clients throughout the West Midlands on all family law matters.
They have expertise in a number of complex areas, including difficult child arrangement cases, and financial matters. Whilst the team strives to settle divorces out of court, they are knowledgeable in how to navigate the court process and ensure their clients are thoroughly prepared.
Navigating court proceedings with skill
Although wherever possible, Stowe lawyers will avoid court intervention, sometimes this is sadly impossible.
The Birmingham team took on a complex case involving several accusations of domestic abuse, as well as complex financial matters. The case had to be taken to court. However, Rebecca Calden-Storr and her team of specialist lawyers ensured that their client was fully prepared and all possible outcomes were discussed in detail.
Thankfully, our client was awarded child custody and a generous financial settlement and was very grateful to the Birmingham team for helping her to navigate a turbulent and highly stressful period.
Keeping children’s wellbeing at the heart of divorce negotiations
Rebecca, Claire, Sara and the team in Birmingham assist clients across the West Midlands with child arrangements for the post-divorce system to be implemented. Child custody can be one of the more contentious issues in divorce proceedings. However, our expert lawyers are adept at making sure the process goes as smoothly as possible and that ultimately the wellbeing of the child or children is central.
The lawyers in Birmingham recently took on a case where the divorcing couple were struggling to create a parenting plan that was in line with the needs of the children and suitable for both parents who worked full time, and the father tended to travel for work.
Our lawyers worked through the process with the parents, and were able to create a child arrangement plan that did not require the intervention of the court. The parents were both happy, and the children would have as much consistency as was possible, whilst still seeing their father who would put in a flexible working request to mean he could be at home more.
Is it worth considering pensions in divorce?
Pensions are one of the most overlooked elements in divorce. It is estimated that over 70% of people ignore pensions in divorce. Although a common error, it is far riskier to ignore pensions than it is to delve into their complications.
Rebecca and the team in Birmingham regularly assist with pension sharing orders. These are orders from the court that require one party to transfer some funds from their pension to the other party.
Recently, the Stowe lawyers took on a complex case where the parties were extremely unequal in their pension wealth.
Stowe’s client did not have a pension pot at all, but knew that her ex-husband had considerable wealth. She was keen to ensure that this was not lost in discussions. Our lawyers guided her through the process of financial disclosure.
After some difficulty where the opposing party did not give full financial disclosure and left out many details about how much pension wealth he had, Claire Clearly who was leading the case along with Sara Morton called in Stowe’s in-house forensic accountancy team.
The forensic accounts were able to discover far more pension wealth than had previously been declared. This was added to the matrimonial pot and a highly satisfactory financial settlement was reached after several sessions of arbitration.
