Navigating the division of a family business
Divorces involving business ownership, or interests, can often lead to disagreement between couples. In a case handled by our Durham family law team included a complex financial settlement involving multiple businesses.
Our client had limited knowledge of the businesses so it was essential to establish these details early on with the help of our in-house Forensic Accountant, as well as determining how the businesses are owned, what they are worth, what income they provide now, and their future income potential.

Ending a civil partnership
Stowe Family Law's team in County Durham recently supported a client through the dissolution of their civil partnership.
As the couple owned a number of properties together, the team worked closely with the client to understand the financial situation and identify the assets that needed to be divided between them. This included the couple's savings, investments, property, and all assets over £500.
After the disclosure process, the team worked closely with the client and the other party’s legal team over a period of months to negotiate a fair settlement that was mutually agreeable.
This was then converted into a consent order by the courts to make it legally binding, with a clean break clause added to prevent future claims.
When court proceedings are the only option
Happily, the majority of Stowe’s family law cases do not result in court proceedings. However, inevitably there are some who cannot agree on matters without court intervention.
In a case handled by our Durham team, our client instructed us in a financial remedy case involving property and pension division which remained unresolved despite attempts to meet a resolution.
After thorough investigation, our team concluded that negotiations had reached a stale-mate, and court proceedings were issued and a hearing date was set.
The team supported the client by preparing them for court, clearly explaining the processes and possible outcomes, whilst also ensuring direct negotiations continued in parallel.
Prior to the initial hearing, a new proposal was offered with a more just settlement, which was accepted allowing our client to avoid court and move forward in life from a more financially secure position.
