Contesting a Will
Disputes about a will or an inheritance happen for a number of reasons. It can be because there is something wrong with the will itself, there was something affecting the will maker’s mind or ability to make the will, or it may be because they have not acted reasonably when deciding who should inherit from them.
Stowe Family Law assists many clients with cohabitation matters. Some wish to draw up a cohabitation agreement to clarify the ownership of shared assets. Others seek practical advice and legal assistance after a relationship has broken down or a partner has died.
Following the landmark decision in the case of Radmacher v Granatino in October 2010, which gave “decisive” weight to prenuptial agreements, Stowe Family Law has seen a marked rise in the number of clients contacting us about a prenuptial agreement in the UK.
Out of Court Settlements
Stowe Family Law offers dedicated family mediation, collaboration and arbitration services which we term out of court settlements, which can also be terms Alternative Dispute Resolution
Collaborative law services are also available, which differs from mediation in that each party has a legal advisor present throughout the process and at all meetings.
Family law arbitration was launched in February 2012 and offers an alternative way to resolve financial family law disputes outside of court. Divorcing couples, or other parties involved in a family law dispute, can now approach a qualified arbitrator to agree a legally binding financial agreement instead of enduring the lengthy and costly court process.

If you are in a civil partnership and the relationship breaks down, you can apply to the court for the partnership to be dissolved. You will receive the same entitlements as a spouse who gets divorced, and can apply for financial provision.
