Yet there are risks. Marilyn Stowe, a senior partner of Stowe Family Law, said that such funding could help to settle difficult, expensive types of disputes “where, no matter how hard the lawyers try, they may find themselves chasing fool’s gold”. She does not recommend it other than a last resort because of the “substantial additional cost to the client” and extra stress created.
In the Young case the judge noted that the costs were exacerbated by repeated changes of solicitors, in part because of funding issues. If lawyers do drop out then clients can end up in a worse position and still having to pay back hefty bills, Stowe said.
