Few situations feel as overwhelming as facing divorce proceedings across two countries at once. Our divorce specialists supported a client through a complex international matter involving divorce proceedings in England and abroad.

The couple had also signed a postnuptial agreement in another country. This complicated which country’s courts should decide the financial outcome. With divorce proceedings running in both England and abroad, there were immediate questions about jurisdiction and how a foreign postnuptial agreement would be treated by an English court.

From the outset, the husband was reluctant to provide a full and honest picture of his finances, which is a cornerstone of any fair financial settlement. Without proper disclosure or interim financial provision in place, our client faced real uncertainty about her day-to-day finances while the proceedings continued.

Holding the other side to account

Our client was guided through years of proceedings by Helen Taylor. The approach was methodical, combining legal expertise with a clear-eyed understanding of what our client needed to feel secure.

Helen worked closely with our in-house forensic accountants, who produced a detailed schedule setting out the deficiencies in the husband’s financial disclosure. This gave the court a clear, evidenced picture of where the gaps lay.

From there, we took decisive steps to protect our client’s position. We successfully applied for a Legal Services Payment Order, and secured an Interim Maintenance Order, putting interim financial provision in place and giving our client a degree of stability while the wider settlement was resolved.

Where the husband failed to meet his obligations, we made the necessary court applications to hold him to account, which was reflected in the costs order the court awarded against him, recognising the additional work his conduct had caused.
