A client contacted our family law solicitors in Bath after more than 30 years of marriage. She had been unhappy for many years due to her husband’s controlling and abusive behaviour.

The client had felt unable to leave her husband, but, encouraged by her adult children, she agreed to attend an initial fixed-fee meeting to understand her legal position.

The husband had been the main breadwinner throughout the marriage. Our client was worried about how she could afford to leave the family home. She was concerned about how divorce would affect her financially and whether she would be properly supported.

How our lawyers advised the client

One of our divorce lawyers, Judit Kerese, spoke to the client and gave her clear advice about what the process ahead would look like. She reassured the client that although her husband had been the main wage earner, the financial settlement would be based on fairness and that both parties’ financial needs would be met, particularly after such a long marriage.

Judit also provided practical advice about the client’s immediate options and how she could leave the family home safely. The client was made aware of how interim maintenance could be applied to help support her financially in the short term. It was also explained that a Legal Services Payment Order (LSPO) could be applied for, which would mean that her husband would pay for her legal costs so that she would not be disadvantaged in her divorce.

After the initial hour-long meeting, the client felt reassured about the options available to her. For the first time in a long time, she felt she could make informed decisions about what she wanted to do next. Following the meeting, she said:
