Resolution argues for no fault divorce

Family law organisation Resolution has argued for the introduction of no fault divorce in the UK.

In a submission to the ongoing Bach Commission on Access to Justice, the organisation said such a system would remove “the need for one party to assign fault to the other”, dubbing this ‘divorce without blame’.

Launched in January, the Bach Commission was set up to “explore establishing access to justice as a fundamental public entitlement.”

The Resolution submission also included other recommendations for the improvement of the legal system. These included the extension of legal aid entitlement to all available methods of alternative dispute resolution and not just mediation, as well as a review of the recent dramatic increase in divorce court fees. The organisation also believes that mediation information and assessment meetings (MIAMs) should take place before the parties have made any application to court.
