Tax experts were consulted to assess the international liabilities attached to the overseas property. Pension actuaries were instructed to properly value the pension assets, as there were figures that could easily be underestimated without specialist input. Detailed valuation reports were produced for all assets, including a robust assessment of the overseas property that reflected its genuine market value, not the artificially reduced figure created by the rental arrangement.

By the time the case reached the final hearing, after a process marked by procedural delays and the opposing side’s failure to meet court directions, our client had a clear, well-evidenced picture of the matrimonial assets that was difficult to dispute.

A fair outcome

The court accepted the higher, accurate valuation of the overseas property, along with the correct pension values. The judge ruled in our client’s favour, securing a fair financial settlement that truly reflected what he was entitled to.

The court also awarded a costs order against his spouse for failing to comply with court directions – a clear recognition that the delays and non-compliance had real consequences.

Although the process took some time and was longer than hoped, our client was ultimately very pleased with the outcome, saying:
