A client who was separating from their spouse approached our divorce lawyers in Windsor. The client was self-employed and not as financially well off as their spouse, who held significant pension assets. From the start, the financial settlement was highly contested.

To resolve the matter, divorce mediation was attempted, but the spouse didn’t want to engage with the process. It was the same with solicitor-led negotiation. In the end, the case could only move forward via formal court proceedings.

The spouse challenged every aspect, including trying to ring-fence their pension as a non-matrimonial asset, stating it should be excluded from the financial settlement.

Securing fair settlements in contested cases

We achieved a fair financial settlement for our client, reflecting the overall marital finances, including pensions. A costs order against the spouse was also made, as the other party was unsuccessful in their application for a further pension report on ringfencing. We defeated this, and in the costs order, we required them to contribute to our client’s costs due to their conduct during the proceedings.
