A client contacted our Windsor family law solicitors for advice about how to enforce a financial order following divorce. It had been agreed that the family home, which the client’s former spouse was living in, was to be sold with the proceeds divided.

Unfortunately, the former spouse made the sale difficult by not allowing viewings of the property. Although an offer was received in the end, they then refused to sign a form that would have allowed the sale to go through, claiming there was a dispute over how the proceeds were to be divided. Faced with this difficult situation, the client contacted us for help.

To do this, she reviewed the enforcement options and wrote to our client’s former spouse, clearly setting out what their obligations were and the consequences of not complying with them. She then applied to the court to enforce the order, making sure the matter progressed and could not be delayed again.

Settlement reached in cost-effective way

As a result of this action, an agreement was reached that brought the matter to a practical and cost-effective conclusion. The former spouse remained in the family home and agreed to buy our client’s share of the property.

A costs order was also applied so that our client was reimbursed for the costs they had incurred due to their former spouse’s delaying the process.
