Emma McMorrow supported a client who had left her marriage following domestic abuse. The former family home was jointly owned, and after separating, the couple had an informal agreement that the husband would stay in the house, keep up the mortgage payments, and make regular lump-sum payments to the wife. This was arranged without taking legal advice.

The husband then stopped making the agreed payments and stopped paying the mortgage, resulting in repossession proceedings being issued. Unfortunately, by the time we were contacted, our client had already gone to the repossession hearing without legal representation, and the court had ordered that the property should be sold.

This included renegotiating the financial settlement and securing full financial disclosure so the court could assess whether the proposed settlement was fair. This result reflected and compensated for the financial damage caused by the husband’s actions. It also removed the need for any further contested hearings, which helped reduce stress and meant the client could move on with confidence.
