The client’s spouse held all the assets, including the family home overseas and successful international companies, solely in their name. The spouse lived abroad while our client and the children were living in London. The issues around jurisdiction, enforcement, asset tracing, and tax all required careful handling by our London high-net-worth experts.
From the start, our approach was to make sure there was full financial transparency so we could protect our client’s best interests. This included securing a restriction on the overseas home so it couldn’t be sold, working with specialist forensic accountants to analyse the spouse’s businesses and challenge claims about their value. We also had to manage complex international tax issues.
After three years of negotiations, a Private Financial Dispute Resolution (pFDR) was finally agreed. The spouse then reneged on this agreement. Jennifer acted quickly, securing a £-for-£ Legal Services Payment Order (LSPO) to ensure the client had the same legal funding and could continue proceedings on a level playing field. Jennifer and the team then represented the client at a three-day final hearing.
The judgment awarded our client 100% of the liquid assets, a secure school fund for the children, the family home, and ongoing maintenance. This outcome ensured long-term financial security for our client and the children, despite the assets being held entirely in the spouse’s name at the start.
