More about us – divorce solicitors Nantwich

More about us – divorce solicitors Nantwich

  • Do I need to give a reason for divorce under the UK no-fault system?

No. Divorce in England and Wales now follows a no-fault system, which means you do not need to prove blame or explain why the marriage ended. The application simply states that the marriage has irretrievably broken down, and the court accepts this without asking for evidence.
While this makes the legal divorce process more straightforward, it does not address finances or child arrangements. Those issues still need to be resolved separately as part of the wider divorce and separation process.
A divorce solicitor can advise on how these matters usually progress alongside the divorce itself.

  • What is the first step when starting a divorce in the UK?

The first step is deciding to apply for divorce and checking that you meet the basic legal requirements. This is followed by making a divorce application, either individually or jointly.
At this stage, it is also sensible to think ahead about finances and any arrangements for children, even if decisions are made later.
Our divorce lawyers often see difficulties arise where applications are issued without early guidance. In particular, where finances or children are involved.

  • How long does the divorce process usually take from start to finish?

Divorce in England and Wales follows a set legal timetable. Even where both people agree, the process takes a minimum of just over six months due to mandatory waiting periods built into the divorce process.
In practice, it can take longer if financial matters or arrangements for children still need to be agreed upon. More complex situations often extend the overall timescale. You can find out more about how long the divorce process takes in our guide.
However, early advice and structured discussions can help prevent unnecessary delay.

  • What am I entitled to financially in a divorce in the UK?

There is no fixed entitlement in a UK divorce, and it is not the case that everything is split 50/50 in a divorce. Rather than applying a set percentage, the court looks at what is fair in the circumstances. In particular, they will focus on needs and, where relevant, the needs of any children.
Financial settlements can include property, savings, pensions, and income. While outcomes vary, they are guided by established legal principles, often discussed when considering divorce finances. A legally binding settlement is needed to bring financial matters to an end.

  • Are pensions shared in a UK divorce?

Pensions are not automatically shared, but they are usually taken into account as part of the overall financial settlement. The law treats pensions as a form of financial asset. Their treatment depends on factors such as their value, the length of the marriage, and how other assets are divided.
There are defined legal options for addressing pensions, all aimed at achieving a fair overall outcome. In our experience advising clients in Nantwich, understanding pensions in divorce early helps ensure they are properly considered as part of the wider settlement.

  • Which family court will I attend if I’m based in Nantwich?

If you are based in Nantwich or the surrounding area and a hearing is required, your case will usually be heard at Crewe County Court and Family Court at The Law Courts, Civic Centre, 78 Vernon Way (CW1 2DP). Our solicitors will ensure you are fully prepared and supported throughout the process.

  • Where is Crewe Family Court and how do I get there from Nantwich?

Crewe County Court and Family Court is located at The Law Courts, Civic Centre, 78 Vernon Way, close to Crewe Market Hall, the Lyceum Theatre and Crewe town centre. It is around a 15–20 minute walk from Crewe Station via Nantwich Road towards the Civic Centre, passing k the Lyceum Theatre and Market Hall.

From our Nantwich office at Stapeley House London Road (CW5 7JW), the court is approximately a 10–15 minute drive via the A51 towards Crewe town centre and the Civic Centre. Nearby cafés include Costa Coffee on Nantwich Road, Starbucks at Grand Junction Retail Park and independent favourite Hops Belgian Bar & Kitchen on Prince Albert Street if you arrive early.

If driving, parking is available at Lyceum Square Car Park and Delamere Street Car Par, both within walking distance of the court.

  • Do I need a solicitor to begin the divorce process?

No, you do not need to have a lawyer to begin your divorce, however, they can bring peace of mind if you’re worried about it.

If you are the one who is submitting the divorce application to the courts, you’re known as the Applicant. Or you could’ve been asked to respond to a divorce application – this means your ex-spouse has begun the process, leaving you as the Respondent.

Whatever side of the process you are on, our experts can help. We have experience in helping Nantwich clients through their divorce, so you’re in safe hands with us.

  • What price can I expect to pay for my divorce?

The cost of your divorce in Nantwich will depend on the complexity of your individual situation. There is a set cost of £612 for the court fee, but the rest is dependent on whether there are any delays during the process, as well as which lawyer you choose.

  • How is ownership of the family home decided when getting divorced?

Usually, the family home is a couple’s biggest asset that needs to be split. However, it’s not always as simple as splitting it 50:50. This is because the courts prioritise fairness above all, so this takes into account how any other assets have been divided and the needs of each individual.

As can be imagined, this is unique to each individual couple and their financial situation.
