  • Do I need a solicitor for a divorce or family court matter, or can I handle it myself?

    You do not have to use a solicitor to get divorced or go to family court. If everything is agreed and your situation is straightforward, many people manage the divorce process themselves.
    Where we often see difficulties is around finances and child arrangements. Agreements about money need to be properly recorded to be legally binding. Court procedure can also feel unfamiliar if you have never been involved before.
    Our Huddersfield divorce experts regularly advise people who started the process alone but wanted reassurance before finalising anything.

  • What is the process for getting a divorce in the UK?

    In England and Wales, divorce is now a no fault process. You apply online or by post, either on your own or jointly, confirming that the marriage has irretrievably broken down.
    There is a minimum 20-week period after the application is issued before you can apply for the Conditional Order. Once that is granted, you wait a further six weeks before applying for the Final Order, which legally ends the marriage.
    Financial matters and child arrangements are dealt with separately. In most cases, it is sensible to resolve finances before applying for the Final Order. A divorce solicitor can explain how this works in practice and what tends to matter in cases like yours.

  • How are finances divided in a divorce in the UK, and is everything split 50/50?

    Finances are not automatically split 50/50 during the divorce process. That is one of the most common misunderstandings.
    The court often starts from the idea of equal sharing, especially in longer marriages. But it then looks at needs, housing, income, pensions, childcare responsibilities and the overall financial position. In many cases, meeting practical needs comes before strict equality.
    Every family’s finances are different. The outcome depends on the full picture. Our lawyers guide Huddersfield clients through what the court is likely to consider, so there are no surprises.

  • How are child arrangements decided in the UK, and do fathers automatically get 50/50?

    There is no automatic 50/50 arrangement for child custody. And the law does not favour mothers over fathers. The court’s focus is always the child’s welfare.
    That means looking carefully at what arrangement best supports the child’s day to day life, schooling, stability and safety. Many parents are able to agree arrangements between themselves. If not, the court will decide based on what it believes is in the child’s best interests.

  • Can one parent stop the other from seeing their child, and what can I do if this happens?

    One parent cannot simply stop contact without a good reason, especially if both parents have parental responsibility.
    If there are genuine welfare concerns, that may justify limiting contact while matters are assessed. But if contact is being stopped without clear reason, the usual first step is mediation. If that does not resolve things, you can apply to court for a Child Arrangements Order.

  • Do you handle cases at Huddersfield Family Court?

    Yes. Most cases are resolved out of court, but if a hearing is required you will attend Huddersfield County Court and Family Court on Queen Street (HD1 2DR). Our solicitors will ensure you are fully prepared and supported throughout the process.

  • Where is Huddersfield Family Court and how do I get there?

    Huddersfield County Court and Family Court is located on Queen Street in Huddersfield town centre, close to Kingsgate Shopping Centre, St George’s Square and Huddersfield Railway Station. It is around a 5–10 minute walk from Huddersfield Station via St George’s Square and Northumberland Street towards Queen Street

    From our Huddersfield office at Empire House, Lewisham Road (HD7 5AL), the court is approximately a 15–20 minute walk or a short drive via Manchester Road (A62), continuing past Huddersfield University, the George Hotel and St George’s Square before reaching Queen Street in the town centre. Nearby cafés include Starbucks and Costa Coffee in Kingsgate Shopping Centre and independent favourite Coffeevolution on Church Street if you arrive early.

    If driving, parking is available at Kingsgate Car Park and Huddersfield Station Car Park, both within walking distance of the court.

  • Responding to a divorce application

    If your spouse has made the application for divorce as a sole applicant, the court will send you (the respondent) a copy of the application by email with a follow-up letter from the court with details of how to access the application.

    You will find the completed divorce application, the Notice of Proceedings, and the Acknowledgment of Service within this email.

    In most instances, you should receive the divorce application within 28 days of it being issued by the court. The applicant however can ask for permission to serve the application later than this.

    You will need to fill in and return the Acknowledgment of Service to the court, usually within 14 days of receipt of the application.

  • What is the process for dissolving a civil partnership?

    Civil partnership dissolution is similar to divorce, but there are some distinct differences.     It’s important to note that the process and terminology differ slightly, but we can help you understand what applies to your situation. We can also support you with child arrangements and financial settlements.
