Our family law services in Stamford

Divorce and separation

With our divorce solicitors in Stamford, the process of divorce or civil partnership dissolution will be simple and straightforward, and Partner Luanne Morton is part of the team, bringing a pragmatic, clear-headed approach to every case she handles. There’s no single way to divorce, so we’ll set out the options so you can choose what suits you: a no-fault divorce handled on a fixed fee for a straightforward, uncontested split, our high net worth divorce experience where significant wealth or business interests are at stake, or, if court feels like the wrong fit for your family, mediation, collaborative law and arbitration as a more amicable route to the same outcome.

Children’s solicitors

Beth Sheridan is ranked Band 3 in Chambers and Partners for her work in children arrangements stemming from divorce and separation, and beyond that, our team can guide you through child arrangement orders, questions of parental responsibility, and special guardianship or child maintenance where they come into play. We’re also experienced in relocation and international children matters, and in helping grandparents secure time with their grandchildren when family relationships become strained.

Pre and postnuptial agreements

Whether you need a solicitor to draft your prenuptial agreement or a postnuptial contract, our experts are here to help, and Associate Charlotte Hallam specialises in exactly this area, drafting prenuptial and postnuptial agreements for clients across Stamford. We can also revisit and update an existing agreement if your circumstances change further down the line, and if you’re parting ways without a formal divorce, we can put together a separation agreement that sets out how you’ll divide things fairly between you.

Finances and divorce

As a financial divorce lawyer, Holly Lamb deals with complex financial cases including business and trust structures, negotiating financial settlements more broadly, making sure pension assets are correctly valued and split, and untangling company shares or family trusts where they form part of the picture. Where a couple was never married, we can also step in on TOLATA property disputes or agreeing ongoing spousal maintenance.

Cohabitation agreements and disputes

Are you aware that unmarried couples that live together have minimal rights? You can change that with a cohabitation agreement, and Associate Anna Clarkson, who holds Resolution’s specialist accreditation in cohabitation and TOLATA work, can make sure you’re properly protected. If you and your partner can’t agree on who owns what in a shared property, a TOLATA claim can settle that, and we can also help separate your finances and living arrangements if things come to an end, or draw up a parenting agreement to record how you’ll co-parent if you have children together.

Domestic abuse support

Having a team around you that you trust is essential – our domestic violence solicitor, Sarah Townsend, provides a clear empathetic approach, whether that means applying for a non-molestation order or an occupation order, or simply having someone to talk to as you work out whether what you’re experiencing counts as abuse, even if it’s financial or emotional rather than physical.

If you need urgent legal protection

If you need urgent help because of domestic abuse, tell the Stamford team at the start of your enquiry. If it is safe to speak by phone, call 0333 00 95044 and explain that you are seeking urgent legal protection. Stowe can advise on urgent family-court protection, including non-molestation orders and occupation orders. Where children may be at immediate risk, the team can also advise on urgent children applications where appropriate.

More about us – divorce solicitors Stamford

More about us – divorce solicitors Stamford

  • How much does a divorce cost?

Divorce costs vary depending on the matters that need to be resolved, particularly where financial issues, property, or child arrangements are involved. After an initial discussion, your solicitor will provide an estimate of costs tailored to your circumstances. You can find further guidance in our divorce costs and family law fees guides. A fixed-fee divorce service is available for straightforward cases.

  • What family court will I attend in Stamford?

If your family law matter requires a hearing, clients based in Stamford will attend Peterborough Combined Court, located at Rivergate, PE1 1EJ, in the city centre. The court is around a 10–15 minute walk from Peterborough Station via Bourges Boulevard towards Queensgate Shopping Centre, and sits near Peterborough Town Hall and Peterborough Central Library. If you arrive early, there are cafés nearby such as Starbucks and Costa Coffee in Queensgate and independent favourite Bewiched Coffee on Bridge Street.

From our Stamford office at Orion House, the court is approximately a 25–30 minute drive via the A1 towards Peterborough city centre and Rivergate, with parking available at Queensgate Car Park and Brook Street Car Park, both within walking distance of the court.

  • Divorce in or out of court?

Wherever possible, our standard approach is to listen to you and support you while you try to settle family-related disputes outside of court. If legal action is required, we have the knowledge and experience to achieve the right result. However, owing to the added time, stress, and money that normally accompany litigation, it is frequently preferable for everyone concerned to settle out of court. But most crucially, keeping out of court is better for the family members who are most susceptible to rifts and dissolution. Divorce can have a lasting impact on children, even decades later. In divorce and separation cases, particularly in the eyes of a Family Court Judge, the wellbeing of the children comes first.

The firm offers arbitration, mediation, and collaborative law as alternatives to litigation.

Should the parties’ negotiations fail, our divorce lawyers are skilled litigators.

  • How long will your divorce take?

If divorcing out of court it is possible to go from submitting the divorce application to decree absolute in 4-6 months. This does not include cases where: i) one party disagrees to the divorce – which makes it a contested divorce and ii) where there are disagreements over children and finances

Going to court will slow the process.

The average divorce takes about 12 months.

It is impossible to give a more exact estimate without first understanding the specifics of a divorce matter and this is also true for the price of your divorce.

  • If you are looking to get divorced or dissolve a civil partnership

Our family lawyers in Stamford are aware of the difficulties and feelings you are experiencing. Additionally, they are aware of how to get past those obstacles and will help you move on and rebuild by providing you with specialist divorce solicitors and linking you to our vast network of services and support staff.

Before detailing the advantages and disadvantages of your available options, we will begin by listening to your specific situation. For example, if you intend to file for divorce, the divorce centre will refer to you as “the Petitioner” after receiving your application. You will be referred to as “the Respondent” if your spouse applies first. Both the Petitioner and the Respondent must take specific and distinct activities at specific times. Your divorce lawyer will describe what these are, the options you have, and the benefits of each. Next, we’ll examine some examples that relate to many people and how we might assist.
