Helping to create a smooth divorce process through 'collaborative divorce'
Going through divorce can be a challenging process. However, there are ways to make it less stressful when a couple is struggling to agree on specific issues arising from separation and divorce, such as finances, property, and child arrangements.
One effective method is through the collaborative divorce strategy. In this approach, the client is the main focus, and the process works through individual issues to produce the right solution for the whole family. It also is an out-of-court strategy, avoiding intervention from the family court.
Collaborative divorce is similar to mediation on the surface. However, unlike mediation, each party has a collaboration lawyer present at all meetings, ensuring consistent legal advice. If necessary, other professionals, such as financial advisors, may be involved.

Spousal Support after divorce
Spousal support is more commonly known as spousal maintenance. Spousal maintenance is introduced when a divorcing couple has agreed, or the court has issued an order, that one spouse pays the other a monthly income. The aim is to help the financially weaker party adjust to their new financial position after separation.
Spousal support can be an issue in divorce proceedings, as there are often disagreements about the level of income needed by the receiving party.
Daren Vythilingum, Team Leader partner in the team, took on a client wanting to divorce her husband, but was worried about her financial position as she had been a stay-at-home mother for the last 10 years of the marriage.
Daren and the Cambridge team worked closely with the client to work out reasonable living expenses and her potential for income as she was re-joining the workforce. It had been agreed that the client would remain in the family home, of which the mortgage had been paid off, until the youngest of the couple’s two children turned 18.
However, even with going back to work part-time and receiving child maintenance, spousal maintenance would be required to maintain a reasonable standard of living for her and her children. The Cambridge team successfully negotiated spousal maintenance payments to equalise the shortfall until a mutually agreed point in the future when it would be reviewed.
