Divorce in England and Wales follows a set legal process. One or both spouses apply to the court to confirm that the marriage has broken down. After a required waiting period, the court makes a Conditional Order, confirming that the legal requirements have been met.
The Final Order legally ends the marriage. Financial matters and child arrangements are not decided automatically as part of the divorce and are dealt with separately, either by agreement or by the court. Divorce in England and Wales follows a fixed legal timetable. Even where both people agree, the process usually takes at least six months from application to Final Order. The court cannot complete a divorce more quickly than this.

There is no automatic rule that finances are split 50/50 in a divorce. The court’s focus is on reaching a fair outcome based on specific legal factors. This includes income, assets, pensions, housing needs, and the needs of any children.
In some cases, this results in equal sharing, but in many it does not. Any financial agreement must be approved by the court to bring financial claims to an end.
