More about our office in Harrogate

More about our office in Harrogate

  • Do I need a solicitor to get divorced in the UK?

No, you don’t need a lawyer to apply for a divorce in England and Wales. Many people deal with the application themselves.
Where things often become less clear is when divorce starts to affect money, property or children. Decisions made early can have a lasting effect. Our Harrogate divorce solicitors often speak to people who are comfortable with the paperwork but want to understand the knock-on effects before going further.

  • Is it worth using a solicitor for a divorce or family law matter?

It depends on the situation. Some cases are straightforward and agreed. Others are more complicated or involve things people don’t want to get wrong, such as asset division.
A divorce lawyer isn’t there to make matters more difficult. Often, the role is to explain what could happen next and help you avoid choices that cause problems later. Many people find that having someone talk things through calmly makes the whole process feel more manageable.

  • What does a family law solicitor do?

A solicitor who specialises in family law explains how the law applies to you and helps you deal with the issues that usually come up when a relationship ends. That can include finances, property or arrangements for children.
The benefit is having someone who’s seen these situations many times before. Divorce and separation don’t always move in a straight line. Knowing what needs attention now and what can wait often helps people feel less rushed and more confident in their decisions.

  • How are child arrangements decided and do fathers have equal rights in the UK?

Child arrangements are decided based on what’s best for the child. The law doesn’t favour mothers or fathers.
This can be reassuring once it’s understood. The focus is on a child’s wellbeing and keeping strong relationships with both parents, where it’s safe to do so. Many parents are able to agree to arrangements without going to court once they understand how the law looks at these situations.

  • Is everything split 50/50 in a divorce in the UK?

No. There isn’t a rule that everything is split equally in a divorce. The law looks at what’s fair, not what’s equal.
What’s fair depends on real-life needs. Things like housing, income, pensions and children all play a part. In some cases, a 50 50 split works. In others, it doesn’t. Knowing this early helps people focus on finding a sensible outcome rather than arguing over numbers.

  • Do you handle cases at Harrogate Family Court?

Yes. Most cases are resolved out of court, but if a hearing is required you will attend Harrogate Civil and Family Court on Victoria Avenue in Harrogate town centre. Our solicitors will ensure you are fully prepared and supported throughout the process.

  • Where is Harrogate Family Court and how do I get there?

Harrogate Civil and Family Court is located on Victoria Avenue, close to Harrogate Convention Centre, Victoria Shopping Centre and the town centre. It is a short walk from Harrogate Station via Station Parade and Prospect Crescent towards Victoria Avenue.

From our office at Copthall Bridge House (HG1 1SP) the court is within walking distance through the town centre. Nearby cafés include Caffè Nero on Station Parade, Starbucks on Cambridge Street and independent favourite Baltzersen’s on Oxford Street if you arrive early.

If driving, parking is available at Victoria Car Park, Jubilee Car Park and the Convention Centre car parks.

  • What is the first step of getting a divorce?

There are multiple avenues for getting a divorce. For example, if you are the person instigating your divorce application, you are known as the Applicant. If you have received a divorce application and been asked to respond, you are known as the Respondent as your ex-spouse has begun the process.

There are varying deadlines for both the Applicant and the Respondent, but our divorce solicitors in Harrogate can help you no matter which side you fall on.

  • How long does the divorce process take?

For a straightforward divorce in England and Wales, you can expect your divorce to take between 6-8 months. However, this is for simple divorces – by this we mean without long negotiations for financial settlements or child arrangement orders.

If your divorce does include these things, you can expect it to take longer than usual. For a more accurate estimate for your specific circumstances, get in touch with our divorce solicitors.

  • How much can I expect to pay for my divorce at Stowe Family Law?

Unfortunately, there is no set price for a divorce. This is due to the complications related to each individual case. One price that is set in stone is the court fee, which is currently £612. This is either paid by the applicant or, if you are joint applicants, applicant 1 will pay this fee.

Our Harrogate lawyers will be able to provide an estimate tailored to your situation, reach out to Stowe Family Law to find out more.

  • Can both parents have custody of the children after divorce?

We recognise that agreeing on child arrangements is never easy. They take into account the family’s decision, the wishes of the children, as well as the suitability of the parents. Sometimes, a family court judge rules on the decision, which could be sole custody for one parent, joint custody, or third-party custody if the judge believes grandparents would be beneficial to the child’s welfare.

  • Will the family home be sold during the divorce settlement?

What happens to your marital home is all dependent on your individual situation. Our Harrogate solicitors will be by your side throughout the process so you always have an expert by your side to ensure you have the best possible outcome.

The dividing of assets will be done as fairly as possible, as this is important to the courts. If each party has different assets, this could impact how joint assets are split. Our experts will be able to explain this to you so you feel confident in your decisions.
