You are not legally required to use a solicitor to get divorced in England and Wales. Some people deal with the divorce application themselves when matters are straightforward and agreed.
However, divorce does not automatically resolve financial claims between spouses. Without a court-approved financial order, financial ties can remain open even after the Final Order is granted. This is often where legal advice becomes important.
Our divorce lawyers in Windsor regularly advise clients at an early stage. This is so they understand what still needs to be formally resolved and how best to approach it. A divorce solicitor can advise based on individual circumstances to help get you the best possible outcome.
There is a 20-week period between the application and applying for the Conditional Order, followed by a further 6-week wait before the Final Order can be requested. In practice, this means the process takes a minimum of around six months. The stages are explained in more detail in our guide to getting a divorce in England and Wales.
Divorce in England and Wales follows a fixed legal timetable under the no-fault divorce law. Even where both parties agree, it cannot be completed immediately.
Finances and child arrangements are handled separately and may take longer, depending on complexity and cooperation. Timescales vary according to individual circumstances.
There is no automatic rule that finances are divided equally in a divorce. The court’s objective is fairness based on the circumstances of the case.
When deciding what is fair, the court looks at factors such as the length of the marriage, income, earning capacity, housing needs, pensions and any children. In some cases, an equal division may be appropriate. However, in others, a different outcome may be justified. Our guide on divorce finances sets out how needs and sharing are usually considered.
Both parties are required to provide full financial disclosure. Many cases are resolved by agreement. However, any settlement should be recorded in a binding court order to ensure financial claims are properly concluded.
Where parents cannot agree on arrangements for their children, the court generally expects them to attempt mediation or negotiation first. This is unless there are safeguarding concerns.
If agreement cannot be reached, either parent can apply for a child arrangements order. The court’s primary consideration is the child’s welfare. Decisions are based on what arrangement best meets the child’s needs rather than on parental entitlement.
Where possible, resolving matters out of court can help reduce conflict and maintain stability for children. Our family lawyers in Windsor advise parents on the options available and how a court is likely to approach their situation.
A family law solicitor advises on legal rights and responsibilities throughout the divorce process.
This can include explaining the legal framework, identifying financial claims, reviewing financial disclosure, negotiating settlements, and preparing court documents. If agreement cannot be reached, they can represent clients in court proceedings.
Our family lawyers provide clear and practical advice tailored to each client’s circumstances. We then help them understand their options and move forward in a measured way.
