You cannot begin divorce proceedings until you have been married for at least a year.
To start, you need to submit an application to the court (Form D8) with a declaration that your marriage has broken down irretrievably.
This is usually made online via a court portal (although you can make a paper application) and requires a payment of £612.
You can apply for a divorce by yourself (sole applicant) or make a joint application with your ex-spouse (joint applicants).
Alternatively, if you receive a divorce application from your spouse, you are called the respondent in the legal process.
Getting this part right early is important in that it will help you to save time and money throughout your divorce process. As any family lawyer or family law solicitor will tell you, it can also make the entire process more amicable as you, and your partner, are clear from the start.
Here at Stowe, our Middlesbrough family law solicitors will support you through the process and offer professional guidance and advice to make your divorce or civil partnership dissolution as quick and convenient as possible. Absolutely we do. We understand that organising your child arrangements (previously known as child custody) is one of the hardest parts of separating. It can be easy to want your child to spend all their time with you, so you know for certain that they’re safe and cared for, but your ex-spouse feels the exact same way.
By having a child law specialist in your corner, we can act as that third party that ensures your child is the top priority. We’ll work with you and your ex to create an arrangement that works for everyone. This way, it’s fair to everyone – your child included.
Separation of any kind is never easy. But especially when it comes to dissolving a civil partnership, which isn’t well known, it can be overwhelming. That’s what we’re here for.
Here at Stowe Family Law, our Middlesbrough solicitors have years of experience in civil partnership dissolution. We’ll talk you through the process in a way that you understand, this way you feel confident in the decisions you’re making regarding your future.

Of course, you’ll also need to arrange any child custody and financial settlements. But we’re here to help you with that.
