No. You don’t have to use a solicitor to apply for a divorce, and many people complete the application themselves. Legal advice is recommended when finances, children, or property are involved, or if things feel uncertain from the start.
A lawyer can help you understand what needs to be dealt with now and what can wait. Our divorce solicitors in North Shields often speak to people early on who simply want to know where they stand.
No-fault divorce means you don’t need to blame your spouse or explain what went wrong. Either of you can apply by confirming that the marriage has irretrievably broken down. You can find out more in our complete guide to no-fault divorce.
After that, the divorce follows a set legal process with minimum timeframes. It’s intended to be simpler and less adversarial. What often catches people out is that the divorce itself doesn’t deal with finances or children. This is usually where legal advice becomes important.
There is no fixed entitlement in a divorce. Financial outcomes depend on individual circumstances, including income, property, pensions, savings, debts and future needs, particularly where children are involved. The law considers fairness across the whole picture, often described in terms of needs and the sharing of divorce finances.
Understanding this early on can help people make more informed decisions as matters progress.
No. There’s no automatic rule that all assets are split 50/50 in a divorce. Sometimes assets are divided equally, but often they aren’t. The focus is on fairness, which means looking at needs, available resources, and what each person will need going forward.
Where children are involved, their housing and care usually carry particular weight. Each case turns on its own facts, so assumptions can be unhelpful.
The way to begin getting divorced is by getting an application or Form D8 and submitting this to the courts for £612. You can either apply for this as a sole applicant or alongside your ex as joint applicants. We always recommend finalising this as soon as possible to prevent any hold ups which could cause further costs.
We recognise that this process is incredibly stressful and overwhelming, so if you need legal support, our North Shields divorce solicitors are here to help. With over 50 years of experience, you can trust we’ve got the expertise to guide you through the process with ease.
For many people, the family home is the main concern. It isn’t looked at on its own, but as part of the overall finances. Depending on the situation, the property might be sold, transferred to one person, bought out, or kept for a period of time. This is often to provide stability for children.
The different ways property is dealt with in divorce tend to turn on affordability and future housing needs.
Your solicitor will be able to provide an initial cost estimate following a meeting to discuss the details of your case. The total cost of a divorce will depend on the complexity of the issues involved, particularly if financial settlements, property matters, or arrangements for children need to be resolved. Further information can be found in our guides to divorce costs and family law fees. For straightforward cases, we also offer a fixed-fee divorce service.
Yes. Most cases are resolved out of court, but if a hearing is required you will attend North Shields County Court and Family Court at The Courthouse on Tynemouth Road (NE29 6AR). Our solicitors will ensure you are fully prepared and supported throughout the process.
North Shields County Court and Family Court is located at The Courthouse on Tynemouth Road, close to North Shields town centre, the Fish Quay and the North Shields Ferry Terminal. It is around a 10-minute walk from North Shields Metro Station via Tynemouth Road towards the town centre and Fish Quay area.
From our office at Royal Quays Business Centre (NE296DE), the court is approximately a 5–10 minute drive or a 25-minute walk via Coble Dene and Tynemouth Road. Nearby cafés include Starbucks at Royal Quays Outlet, Costa Coffee on Bedford Street and independent favourite Pink Lane Coffee at the Fish Quay if you arrive early.
If driving, parking is available at Royal Quays Outlet, Bedford Street car park and North Shields town centre car parks, all within walking distance of the court.
The length of the divorce process depends on the complexities of the case. If it is a simple divorce, it usually takes between 6-8 months.
If your case is more complex though – due to financial ties, child arrangements, or disputes – the process will take far longer. This also impacts how much your divorce will cost.
You’re going through the motions of separating and then you’re asked to respond to divorce application. Talk about a stressful situation. To respond to an application for divorce, you need to confirm you have received it and whether or not you choose to dispute.
Our lawyers know this is tricky, especially with all the legal technicalities. When you choose Stowe Family Law, you’re choosing a specialist team who has years of experience. We’ll listen to your circumstances and guide you through the process with continued support, so you feel confident about your future post-divorce.
