More from our St Albans divorce lawyers

More from our St Albans divorce lawyers

  • How much does divorce cost?

Divorce costs will differ when there are financial matters or child arrangements to work through. Following our initial meeting with you, our solicitors can provide you with a cost estimate based on your needs. You can also find further guidance in our “how much does divorce cost?” overview and in our detailed pricing information. For simpler, more straightforward cases, we offer a fixed-fee divorce option.

  • Where is St Albans Family Court and how do I get there?

St Albans Civil and Family Court is located at the Civic Centre on St Peter’s Street in St Albans city centre, near St Albans Clock Tower, the Museum + Gallery and the Alban Arena.

From our St Albans office at Clockhouse Court, London Road (AL1 1LA), it is a 5–10 minute walk towards the city centre via London Road and St Peter’s Street. It is also around a 10–15 minute walk from St Albans City Station via Victoria Street, passing The Maltings, with nearby cafés including Costa Coffee and Caffè Nero if you arrive early.

For more detail, see our guide on what to expect at St Albans Civil and Family Court.

  • Do I need a solicitor to help with my divorce?

No. You’re not legally required to use a solicitor to get divorced. You can manage the process online with the no-fault divorce system.
The divorce process can start to get more complex when finances, property and child arrangement matters become involved. If you reach a financial agreement but don’t have it approved by the court, it isn’t legally binding. Understanding how divorce finances are explained under the law often changes how people approach those conversations.
Getting advice early doesn’t mean you’re preparing for conflict. It simply means you understand your position before making decisions. Our divorce solicitors in St Albans can advise based on your individual circumstances.

  • How are finances divided in a divorce in the UK?

There isn’t a fixed formula. And it’s not automatically 50/50.
The court’s job is to reach something fair. It looks at housing needs, income, pensions, childcare responsibilities and the length of the marriage. If children are involved, their welfare is usually the main focus.
If you’ve heard that everything is split down the middle, it’s worth considering whether everything is split equally in divorce. This is because the reality is often more nuanced than that.
Both of you will need to show everything you have, openly and honestly. Many settlements are agreed through negotiation. However, they still need to fit within the law. Our family lawyers can explain how that applies to your situation.

  • Are pensions and savings included in a divorce settlement?

Yes, and pensions are often the asset people overlook.
In longer marriages, especially, a pension can be worth as much as, or sometimes more than, the family home. Savings, investments and property are all considered together.
There are different ways pensions can be dealt with. They may be shared. They may be balanced against other assets. The detail matters, which is why understanding pensions in divorce is important before anything is agreed.

  • How are child arrangements decided after separation?

The starting point is always the child’s welfare. That doesn’t change.

There are no automatic rights based on being the mother or the father. The court asks a straightforward question: what arrangement best supports a child’s stability, safety and a steady relationship with both parents?

Most parents are encouraged to make their own arrangements, and many do. If agreement isn’t possible, the court can make a child arrangements order.

Our family law solicitors in St Albans regularly guide parents through this process; we help them reach workable agreements without a final hearing.

  • When should I speak to a family law solicitor?

Earlier than feels strictly necessary. You should speak to a family solicitor as soon as separation is being considered, especially before agreeing on financial terms or making decisions about the family home or pensions. By the time everything feels settled, some choices may already have been made, sometimes without realising it.

If you’re in St Albans and unsure where you stand, speaking to our family solicitors doesn’t commit you to court; instead, it gives you clarity. And sometimes that alone makes the next steps feel less uncertain.

  • Updates from our St Albans office

Rachel joined Stowe’s St Albans office as a Team Leader Partner in March 2023. Rachel has practised in all areas of family law, but more recently has focused on complex financial remedy proceedings and TOLATA matters. She has developed a specialism in those cases which involve assets which have been inherited post-separation.
