In a marriage spanning over thirty years, the parties were at an impasse regarding the family home's ownership and the division of pension pots. Taking over the case, the team recognised the stalemate in negotiations, prompting the initiation of court proceedings.
The team supported the client through court preparation, explaining processes, and ensuring ongoing direct negotiations. Fortunately, a new proposal, offering a fairer and more realistic settlement, was presented before the initial hearing, leading to its acceptance and the avoidance of court proceedings.
Formalising Child Custody Arrangements
The Sunderland team frequently assists separated parents in Tyne and Wear struggling to agree on custody arrangements for their children. In a specific case, they represented a father of two young children who, despite negotiating custody with the mother, faced non-compliance.
After consultation with the team, it was decided to apply to the court for a child arrangement order, formalising the custody agreement. Using their expertise in Child Law, the team developed a custody arrangement that prioritised the children's best interests.
This arrangement was presented in court, and after legal proceedings, a child arrangements order was issued, reflecting the agreed-upon child custody arrangement. The formalised arrangement provided stability and routine for the children, contributing to improved relations between the parents.
Concluding a Civil Partnership
Stowe Family Law's Sunderland office recently assisted a client through the dissolution of their civil partnership. The couple, one of the first same-sex couples to enter into civil partnerships in 2005, decided to dissolve their partnership at the beginning of 2021.
While the couple did not have children, they had acquired a small property portfolio and high-value items. The Stowe team collaborated closely with the client to understand the financial situation and identify assets for equitable division, including savings, investments, property, and assets over £500.
Following the financial disclosure process, the team worked with both parties' legal teams to create a fair settlement. After months of negotiations, an agreement was reached, which was then formalised into a consent order by the courts, including a clean break clause to prevent future claims.
