Law Commission recommends allowing pre-nuptial agreements
Marilyn Stowe, a leading divorce lawyer, noted the commission had built in safeguards but she said it might not prevent future divorce legal wrangles as couples may argue about the fairness of the pre-nup.
Any proposals to give guidelines on maintenance would be welcomed by husbands, she added: “I think it can be very unfair on wealthier parties, usually the husband, who have non-time-limited maintenance and then go off and make a new life with new obligations and he and a second wife are still paying for the first wife,” she said.
